The team of EDAS Law Bureau, led by the partner of the tax practice Anton Yarmak, vindicated in the appeal instance two earlier made decisions by the Arbitration Court of Moscow Region on the recovery from the Territorial Health Insurance Fund in an amount exceeding 260 million rubles.

The issued judicial acts were the first case of recovery of such significant amounts in favor of private clinics from the territorial health insurance fund.

The problem of payments to clinics for medical care provided to nonresidents was one of the most acute in the system of compulsory health insurance. The reason of the problem is the long-term practice of the territorial funds of the compulsory health insurance, the illegality of which our team was able to detect and prove in the court.
